Federal Judge Overturns Gay Marriage Ban in California…Prop.8 Headed For Supreme Court Battle

Controversial Proposition 8, more commonly known as the ban on Gay marriage law, which was voted in to law by a majority of Californian’s in the 2008 election, has been ruled unConstitutional, and has been over turned by a Federal judge.(SOURCE)

The ruling by the Judge touched off a celebration outside the courthouse.

Chief U.S. District Judge Vaughn R. Walker overturned Proposition 8 Wednesday in a landmark ruling in a lawsuit filed by two gay couples who claimed that the ban on same-sex marriage violated their constitutional rights.(SOURCE)

Here is an excerpt of the ruling by Judge Walker….“Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite sex couples are superior to same-sex couples,” Walker wrote in his ruling. “Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis, the court concludes that Proposition 8 is unconstitutional.”(SOURCE)

Gov. Arnold Schwarzenegger praised a San Francisco’s judge decision throwing out California’s ban on same-sex marriage, saying it “affirms the full legal protections and safeguards I believe everyone deserves.”

I bet the Republicans are upset with Gov. Schwarzenegger for coming out to support the overthrowing of this hateful bill they concocted, but the State of California respects him for following his conscience, and doing the right thing.

We can never say that Gov. Schwarzenegger is a Republican sycophant!

A rush to the altar by same-sex couples is not expected until the ruling is finalized,but as it stands now…they certainly have that option.
